UPDATE

 

This is the first newsletter since June. While there have not been any major developments over the summer the Executive Committee has continued to meet monthly to monitor ongoing issues especially those pertaining to the class action lawsuit. In addition, planning has begun on the Annual General Meeting to be held on October 19th. Outlined below is the information regarding these pending issues.

 

LEGAL DEVELOPMENTS 

 

As outlined in earlier newsletters Koskie Minsky, a prominent Toronto law firm, has been chosen to represent CLPENS in its ongoing dispute over the Canadian Canada Life Pension Plan. This was moved forward when it was learned that the law firm of Harrison Pensa had filed a Statement of Claim on Feb. 3, 2005 on behalf of Mr. JP Marentette, a former employee of Canada Life in London, Ontario.

 

Koskie Minsky filed a Statement of Claim on May 11, 2005 on behalf of Messrs David Kidd and Alex Harvey, as members of the partial plan windup group.

 

The Statement of Claim for Kidd-Harvey is now up on the CLPENS website. There is also a link to the Marentette Statement of Claim via the Harrison Pensa website.  As noted in the last newsletter Koskie Minsky contacted Harrison Pensa regarding their statement of claim and Harrison Pensa agreed to join as co-counsel as the case moves forward.

Again note that this claim will be amended to include Mr. JP Marentette as plaintiff, and to incorporate his statement of claim. To review this statement of claim, click on:

Once Mr. Marentette has been added to the Kidd-Harvey claim, the Marentette claim will be discontinued. Both law firms are currently working together during this process and will continue to work together after the two claims are combined.

 

 We urge everyone to visit the site and review the Statements of Claim. We would also welcome comments and questions from the membership that we will use as a basis of future newsletters.

 

At this time the Statements of Claim are only available via the website and in PDF format.  When the final statement of claim has been filed, we will send a copy to those members who receive our correspondence by regular mail.

 

 

MEMBERSHIP UPDATE

 

Membership is around the 1000 level with close to 250 voting members as of Sept. 7th. We again ask the membership to make anyone with an interest in the Canadian Canada Life Pension Plan aware of this group and encourage these individuals to join.

 

 

ANNUAL GENERAL MEETING -October 19, 2005

 

The 2005 Annual General Meeting has been set for the evening of October 19th from 7 PM to 8:30 PM.

 

The purpose of the meeting is to bring everyone up to date on the ongoing developments as well as electing the slate of officers for the next year. The agenda for the meeting will be included in the next newsletter, which will be published the first week of October.

 

Mark Zigler of Koskie Minsky has agreed to make a presentation at our October meeting on the legal aspects of our case.  He has also agreed to answer any questions.

 

As outlined in the constitution, in order to be eligible to vote at the Annual General Meeting you must be a voting member.  To become a voting member you must pay a one-time initiation fee of $100 and an annual fee of $25. If you have not already become a voting member we suggest you complete a form that is available on the web site and forward it with a cheque for $125.  All current-voting members will be eligible to vote at the 2005 AGM on Oct. 19th.  For voting members the $25 annual fee for the 2005/2006-year will become due in October. You can mail a cheque to or you can drop it off at the AGM next month. The mailing address is:

Branch 66 is located on Spring Garden Ave., two blocks north of Shepherd and Yonge St. At Spring Garden Ave. turn right (east).  The Legion is the first building east of Yonge on the north side.

 

For those who are driving parking is located on a strip abutting the east side of the Legion.

 

Following the meeting there will be an opportunity to socialize with old and new friends.  We look forward to seeing many of our members on October 19th. We hope you will plan to attend.
